Man arrested twice for DUI by same officer in same location

On March 24, a Chicago man was arrested on suspicion of drunk driving on the 7300 block of Ogden Avenue in Riverside. Oddly, the man was arrested in the same location by the same officer seven years ago.

According to media reports, the 46-year-old defendant was pulled over by police at around 2:20 a.m. for driving 55 mph in a 30 mph zone. He submitted to a sobriety test, which he allegedly failed, and then he reportedly tried to kick and punch the officers as they placed him under arrest. According to the arresting officers, his aggressive demeanor continued as he was transported to jail. The officers also said he confessed to drinking alcohol and taking two prescription drugs before getting behind the wheel.

The defendant was charged with DUI, speeding and resisting an officer. In 2011, he was arrested in the same spot by the same police officer. The Riverside police chief said that this case is a reminder that many drunk driving defendants continue to offend until they are sent to jail or undergo substance abuse treatment.

If convicted, repeat drunk driving defendants often face harsh penalties, including incarceration and fines. They could also have their driving privileges revoked or restricted. However, a criminal defense attorney could help protect a defendant's future by fighting the allegations in court. In some situations, it may be possible to get the charges dismissed. In others, an attorney may try to negotiate a plea deal that reduces the charges and consequences. For example, the defendant may be able to enter an alcohol treatment program in lieu of going to jail.
