A nationally renowned rap star has been cleared of weapons infractions n Chicago. A police search of his domicile had turned up firearms that the man would not have been able to legally possess because of probation laws, but a judge’s ruling caused the prosecution to drop the charges against him.
Prominent rap vocalist Durk Banks, better known by his stage name of Lil Durk, gave his legal counsel a large proportion of the credit for the successful criminal law defense against the charges. There were 12 felony weapons charges against Banks, but the prosecution had to drop the case entirely because of problems with the evidence that were uncovered by the attorney for the defense.
The weapons were found in the rapper’s townhouse during a search for a murder suspect, but his lawyer was able to demonstrate to the satisfaction of the court that Mr. Banks had not admitted to the ownership of the gun. Instead, the prosecution could not conclusively prove that the weapons were in hiss possession or control. Although the prosecutor claimed that Banks had admitted that the weapons were his, the police report omitted it, and thus ownership could not be conclusively proven.
Weapons charges are taken seriously in Illinois. The penalties that could be assessed if a conviction is obtained could be severe, including incarceration and hefty fines.
