"Pawn Stars" star facing felony drug and gun charges

Illinois residents who enjoy reality television are likely familiar with Austin Russell. The 33-year-old celebrity, who is more widely known as 'Chumlee," is a popular figure on the popular History Channel show 'Pawn Stars," but police in Las Vegas were not looking for an autograph when they arrived at his suburban home on March 9. Police say that they went to Russell's home because a woman had accused the reality TV star of sexually assaulting her, but reports indicate that they took him into custody after discovering large quantities of drugs and several firearms.

Police say that they found 12 firearms including shotguns, rifles and handguns located in two safes in Russell's home along with a large quantity of ammunition. Four of the recovered guns are said to have been registered to the television star. The police say that they also recovered quantities of marijuana, methamphetamine and a large quantity of drug paraphernalia. Russell was subsequently taken into custody on weapon and drug charges and transported to a Clark County detention facility.

Police say that they were able to establish probable cause and seize the guns because the law prohibits individuals who use illegal drugs from owning firearms. Russell was released after posting a bond of $62,000.

The Fourth Amendment of the U.S. Constitution provides protections against unreasonable searches and seizures, and police officers must generally secure a warrant before conducting searches. However, simply being in possession of a warrant does not necessarily give police the right to look wherever they please. Criminal defense attorneys may seek to have evidence recovered in a search excluded even if a warrant has been issued when police have gone beyond the scope of the warrant or the warrant was granted based on faulty, false or incomplete information.
