Penalties for Marijuana/Cannabis Possession

As with most drug crime charges, the penalties for marijuana possession will depend on the amount you were accused of possessing. Any person who knowingly possesses cannabis, even in the smallest amount possible, can be subject to criminal charges.

Typically the charges go as following:

  • 2.5 grams or less: Up to 30 days in jail and a potential fine of $1,500.
  • 2.5 to10 grams: This is considered a Class B Misdemeanor and can result in up to 180 days in jail and a similar fine.
  • 10 to 30 grams: As a Class A Misdemeanor, you will face up to a year in jail and a maximum fine of $2,500.
  • 30 to 500 grams: If convicted, you could face up to 3 years in prison plus a fine up to $25,000.
  • 500 to 2,000 grams: This is a Class 3 Felony and can result in 5 years in a state penitentiary and a $25,000 fine.
