What Is the Difference Between a Misdemeanor and a Felony?

Charges for any crime can result in serious penalties and high fines, but some crimes are classified as worse than others. In general, criminal offenses are split into two main categories: misdemeanors and felonies.

Basic Overview of Misdemeanors & Felonies

Lesser offenses are misdemeanors, while more serious crimes are charges as felonies. The main difference between the two is that misdemeanors are penalized with fines and possible incarceration in the county jail, while felonies incur much higher fines and possible incarceration in a state prison. Felons are also restricted from purchasing or possessing firearms.

Misdemeanor Classifications in Illinois

If convicted of a misdemeanor such as assault, possession of marijuana, or DUI, you could face a fine and / or time in the county jail. Illinois classifies misdemeanors as follows:

Class A Misdemeanor

  • Up to 1 year in jail
  • Fine of up to $2,500

Class B Misdemeanor

  • Up to 6 months in jail
  • Fine of up to $1,500

Class C Misdemeanor

  • Up to 30 days in jail
  • Fine of up to $1,500

Illinois Felony Classifications

If convicted of a felony such as aggravated assault or battery, possession of a controlled substance, or aggravated criminal sexual assault, you could face a high fine and / or time in state prison. Illinois classifies felonies as follows:

Class X Felony

  • 6 - 30 years in state prison
  • Fine of up to $25,000

Class 1 Felony

  • 4 - 15 years in state prison
  • Fine of up to $25,000

Class 2 Felony

  • 3 - 7 years in state prison
  • Fine of up to $25,000

Class 3 Felony

  • 2 - 5 years in prison
  • Fine of up to $25,000

Class 4 Felony

  • 1 - 3 years in prison
  • Fine of up to $25,000
